"Whacked" is the twenty-third in Season Three of CSI: Miami.

Synopsis

An axe murderer on death row is given a stay of execution just moments before it was to take place, on the grounds that there may have been tainted DNA analysis used at his trial. Now, without using any DNA evidence, the team must race against time and reexamine all of the physical evidence in the case, just as they get a call on a new double murder that looks suspiciously like the case they're working on.

Plot

Ken Kramer, a serial killer in death row, is given a stay of execution after a murder very similar to his M.O is discovered. After tracking Kramer's history as well a series of seemingly unrelated crimes the teams finds out Kramer actually had an accomplice during the original murders and that's the new killer. The accomplice is revealed to be Kramer's cousin, Larry Hargrove, but when Horatio confronts Kramer in jail he confesses Larry didn't kill the victims he's been executed for. The execution is allowed to begin, but just before that Kramer commits suicide by eating a peanut butter and jelly sandwich-he was allergic to peanuts. Interspersed throughout the episode are scenes of a man walking in the woods with an axe, Kramer's favorite killing weapon, however the ending reveals the man is actually a lumberjack hacking the wood for Kramer's casket, with the final scene showing Horatio looking at his body laying there and closing it.
